We make reasonable efforts to pre-screen potential buyers; however, we do not guarantee the identity, intent, or accuracy of any information provided by such parties and shall not be liable for any misrepresentation, fraud, or actions taken by third parties.


By continuing to use our Website and/or Services, you consent to receive communications from us in electronic form, including emails, text messages, and phone calls. Standard message and data rates may apply depending on your carrier.


It is your responsibility to ensure the contact information you provide (including email address and phone number) is accurate and up to date. Timely responses to our communication requests are essential for the effective marketing of your unit.


We may use artificial intelligence or AI-powered tools to provide and improve our services, enhance user experience, and support customer interactions. The availability, performance, and accuracy of such tools are not guaranteed.


We take appropriate security measures to protect your data; however, we cannot guarantee complete security over the internet. By using our services, you acknowledge and accept this risk.


Scope of Services 


Registry Motors LLC provides advertising and marketing services to private sellers.  We are not a buyer or seller of any Listed Item.  All users act solely on their own behalf and are fully responsible for any actions they take, including any transactions they enter into.


Registry Motors LLC operates solely as a marketing and advertising service provider. We are not acting as an employee, agent, representative, broker, dealer, lender, appraiser, or any other intermediary for any private seller. We do not have possession of any advertised  Item(s) at any time.  


We may use artificial intelligence or AI-powered tools to provide and improve our services, enhance user experience, and support customer interactions. The availability, performance, and accuracy of such tools are not guaranteed.


These Terms outline the mutual rights, responsibilities, and expectations between “you” and Registry Motors LLC. 


We will promote your unit across our network of websites, social media channels, and approved third-party classified or auction platforms, as discussed and agreed upon at the time of purchase. Marketing efforts will continue until the unit is sold or until services are otherwise terminated in accordance with these Terms. This provision does not include advertising on eBay Motors, Equipment Trader, or Hemmings as listings on these sites are timed events.


Please review your advertisements as soon as you receive them from us.  You must review the advertisement and notify us within 24 hours of any corrections or necessary changes. If no response is received within this period, the advertisement will be deemed accurate and approved.

You are responsible for providing accurate, complete, and current information regarding your unit, including but not limited to the VIN, specifications, condition details, and high-quality photos. We are not liable for inaccuracies, omissions, or misrepresentations in your advertisement that result from incorrect, incomplete, or outdated information supplied by you.


We will monitor your advertisement and notify you of legitimate offers received at or above seventy-five percent (75%) of your asking price. Notifications may be sent via phone call, text message, or email.


National Equipment Registry


National Equipment Registry (“NER”) is a brand operated by Registry Motors LLC. All payments for services purchased through National Equipment Registry are processed by Registry Motors LLC. Customer receipts and bank/credit card statements will show Registry Motors LLC as the merchant of record. By purchasing services from National Equipment Registry, you acknowledge and agree to this billing arrangement.


Payment Terms & Refund Policy


All major credit cards are accepted. You are purchasing marketing services only, not a guaranteed sale. Once your marketing service begins, all fees are non-refundable.


You acknowledge that we cannot control buyer behavior, market conditions, or pricing fluctuations. The success of your campaign may be affected by factors such as price, condition, seasonality, and location.


Registry Motors LLC maintains a strict No Refund Policy. Marketing services are paid for upfront and delivered immediately through labor, platform fees, and ad placements. If you choose to purchase additional services later, a new payment will be required.


Chargebacks and Disputes


We are committed to resolving any issues you may have and expect you to contact us first to attempt resolution in good faith before initiating a credit card chargeback.

Failure to attempt resolution before initiating a chargeback may be considered a breach of this agreement, and we reserve the right to respond accordingly, including contesting the chargeback and terminating your access to services.


Disclaimer of Warranties and Service Limitations


Our services and website are provided on an “as is” and “as available” basis. Registry Motors LLC makes no express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, or performance expectations.


We do not guarantee uptime, ad views, or that the Website or advertising platforms will be error-free or uninterrupted. We are not liable for actions or changes made by third-party advertising platforms. You acknowledge and accept that success is not guaranteed.


We reserve the right to adjust platform usage, services, features, or content at any time, without prior notice.


Indemnification


You agree to defend, indemnify, and hold harmless Registry Motors LLC and its affiliates, vendors, employees, and agents from any claims, damages, or liabilities arising from:

  • Any inaccurate or misleading information you provided,
  • Your breach of these Terms,
  • Misrepresentation of your unit,
  • Any claims arising from your interaction with prospective buyers.

Your Responsibilities


By using our services, you agree to:

  • Review and approve your advertisement draft within 24 hours,
  • Provide truthful, complete, and accurate information
  • Refrain from submitting libelous, copyrighted, or misleading content,
  • Notify us within 24 hours if your unit sells or is no longer available,
  • Provide the unit as described once a buyer is secured
  • Sell the unit at the agreed-upon advertised price,
  • Avoid sharing any third-party intellectual property without permission.

You retain ownership of your unit during the marketing period.


Links to Other Sites


We may provide links to third-party websites or services as a courtesy. Registry Motors LLC is not responsible for the content, policies, or practices of these external sites and does not guarantee any outcomes resulting from your interaction with them.


Termination of Services


Either party may terminate the business relationship at any time for any reason, including the sale of the unit or breach of these terms. We reserve the right to limit, suspend, or remove your advertisement without warning if you fail to comply with these Terms.

 

"AS IS" AND "AS AVAILABLE" DISCLAIMER


The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind that the Service will meet your requirements, achieve any intended results, operate without interruption, meet any performance or reliability standards or be error free. We can not make any promises or guarantees as to when or if any given vehicle (unit) will sell, nor can we control the conduct or actions of buyers or sellers, therefore we maintain a no refund policy.

We can amend these Terms of Use at any time and will update these Terms of Use in the event of any such amendments. It is your sole responsibility to check the Site from time to time to view any such changes in this agreement. Your continued use of the Site or the Service signifies your agreement to our revisions to these Terms of Use. We will endeavor to notify you of material changes to the Terms by posting a notice on our homepage and/or sending an email to the email address you provided to us upon registration.


LIMITATION OF LIABILITY
